Terms of use.
Last updated July 16, 2026. These terms govern access to the public Fermata Digital website.
Acceptance of these terms
By accessing or using this website, you agree to these terms and acknowledge our Privacy Notice. If you do not agree, please do not use the site. If you use the site on behalf of a company or other organization, you represent that you have authority to act for it.
Information, not professional advice
The website provides general information about Fermata Digital Inc., our marketing automation practice, and work we may offer. It is not legal, financial, accounting, security, or other professional advice for your particular circumstances. You are responsible for evaluating information before relying on it.
Reading the site, sending an inquiry, joining an interest list, or speaking with us does not create a client, consulting, fiduciary, confidential, or other professional relationship.
Services and project work
Any engagement must be described in a separate written agreement signed or otherwise accepted by Fermata Digital Inc. and the client. That agreement—not this website—will govern scope, deliverables, fees, timing, ownership, confidentiality, data handling, warranties, and other project terms. Website descriptions and conversations before an agreement are not a commitment to accept or perform a project.
FunnelMata preview
FunnelMata is presented as a product that is coming soon. Screenshots, feature descriptions, workflows, timing, and availability are illustrative and may change. Joining an early-interest list does not guarantee access, a release date, particular functionality, pricing, support, or continued development.
Ownership and limited permission
The site, including its text, design, visual identity, graphics, screenshots, and other content, is owned by or licensed to Fermata Digital Inc. and is protected by applicable intellectual-property laws. Subject to these terms, Fermata grants you a limited, revocable, non-exclusive, non-transferable permission to view the public site and share links for lawful personal or internal business purposes.
Except as permitted by law or with our prior written permission, you may not copy, modify, republish, distribute, sell, license, create derivative works from, or commercially exploit site content. Fermata Digital, FunnelMata, and associated branding may not be used in a way that suggests endorsement, affiliation, or authorization without written permission.
Acceptable use
You may not use the site to violate law or another person’s rights; attempt unauthorized access; probe or circumvent security; introduce malicious code; interfere with operation; impersonate another person; misrepresent affiliation; collect information about visitors; or use automated means in a manner that disrupts, burdens, or extracts substantial portions of the site.
We may restrict access when reasonably necessary to protect the site, visitors, our providers, or our rights.
Third-party services and links
The site may link to or rely on third-party services. Links are provided for convenience and do not mean Fermata controls or endorses the third party, its content, availability, security, or policies. Your use of a third-party service is governed by its own terms and privacy notice.
Availability and disclaimers
We try to keep the site useful, accurate, and available, but information may become incomplete or outdated and access may be interrupted. To the fullest extent permitted by law, the site and its content are provided “as is” and “as available,” without express or implied warranties, including warranties of accuracy, availability, non-infringement, merchantability, or fitness for a particular purpose.
Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, Fermata Digital Inc. and its directors, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities, arising from or related to this public website.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing in these terms limits liability that cannot lawfully be limited.
Governing law and venue
These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. To the extent a dispute relating to this website is not governed by a separate written agreement, the state and federal courts located in Los Angeles County, California will have exclusive jurisdiction, and you consent to their personal jurisdiction and venue.
Changes, severability, and waiver
We may update these terms by posting a revised version on this page. Changes apply from the stated effective date. If a provision is held unenforceable, the remaining provisions will continue in effect and the provision will be enforced to the maximum extent permitted. A failure to enforce a provision is not a waiver of the right to do so later.
